2.Noguarantees are to be made by the Seller regarding the accuracy of the itemslisted;

3.Thepictures provided may have been taken prior to inventory being listed forsale. Some items seen in the pictures provided may be subject to prior sale.The parts list provided is listed as true to the best of the Sellers knowledge;

4.TheSeller makes no express or implied warranties, including, without limitation,warranties of merchantability and fitness for a particular purpose andexpressly disclaims same; and the Buyer waives same;

5.TheSeller disclaims all legal responsibility for product defects that might causeharm;

8.TheBuyer assumes all risks as to the quality and performance of the Goods. Thereare no warranties that extend beyond the description of the face hereof;

9.TheBuyer acknowledges that the Seller expressly disclaims any responsibility forspecial or consequential damages arising out of the use of the material(s) andrelated equipment after the date of shipment to the Buyer;

10.IfGoods is (are) to be exported (out of the Canada.), it is the Buyer\'sresponsibility to follow any required export procedures.

11.Buyeris responsible for shipping costs.

12.Buyer hasnow been made aware that this item has been in storage for sometime and sellerwill make available any paperwork that is available with the item.

INDEMNITY

The Buyer will indemnifyand hold the Seller (our affiliates and subsidiaries and their respectiveofficers, directors, employees, agents) harmless from any claim or demand,including reasonable legal fees, made by any third party due to or arising outof your breach of this User Agreement, your improper use of our Services or ourSite or your breach of any law or the rights of a third party.

SHIPPING CLAUSE & LIABILITY WAIVER

The Buyer is responsiblefor all shipping and handling fees. All orders will be Local Pickup or shippedvia freight with the Buyer responsible for scheduling and providing the Sellerwith proper shipping documentation. Shipping & handling fees of oversizeitems will be determined during the payment process. The item(s) of this salemay be shipped without insurance if the Buyer expressly requests this duringthe shipping process with the Buyers freight company. Without otherarrangements with the Seller, the Buyer agrees to ship all orders 5 days aftertime of payment.

The Buyer assumesany and all liability and risks which may arise from any shipments. Further,the Buyer agrees on behalf of itself and its successors and assigns toindemnify, hold harmless and release the Seller its directors, officers,employees and agents, from any responsibility or liability for any and alldamage or loss that may result during the shipping process.
