By offerdingon this material the Buyer, hereby agrees to all terms and conditions of theSeller.SOLD AS IS WHERE IS - Located in CanadaThe Buyer understands that the Goods sold here contain used material andagree that the Goods are purchased AS-IS, WHERE-IS and with NO RETURNS. Unlessotherwise prohibited by law, Buyers agree that:
1.Part Numbers, Description, Quantities, Conditions, etc. are listed astrue to the best of the Seller\'s knowledge;

2.No guarantees are to be made by the Seller regarding the accuracy of theitems listed;

3.The pictures provided may have been taken prior to inventory beinglisted for sale. Some items seen in the pictures provided may be subject toprior sale. The parts list provided is listed as true to the best of theSellers knowledge;

4.The Seller makes no express or implied warranties, including, withoutlimitation, warranties of merchantability and fitness for a particular purposeand expressly disclaims same; and the Buyer waives same;

5.The Seller disclaims all legal responsibility for product defects thatmight cause harm;

6.The Seller shall not be liable for any general, consequential orincidental damages, including, without limitation, any damages for loss of use,loss of profits or diminution of market value, and the Seller shall not beliable for any damages claimed by the Buyer or any other person or entity uponthe theories of negligence or strict liability in tort;

7.If the Goods should for any reason prove to be defective, the Buyerassumes all costs for servicing and repair of such defect(s);

8.The Buyer assumes all risks as to the quality and performance of theGoods. There are no warranties that extend beyond the description of the facehereof;

9.The Buyer acknowledges that the Seller expressly disclaims anyresponsibility for special or consequential damages arising out of the use ofthe material(s) and related equipment after the date of shipment to the Buyer;

10.If Goods is (are) to be exported (out of the Canada.), it is the Buyer\'sresponsibility to follow any required export procedures.

11.Buyer is responsible for shipping costs.

12. Buyer has now been made awarethat this item has been in storage for sometime and seller will make availableany paperwork that is available with the item.

INDEMNITY

The Buyer will indemnify and hold the Seller (our affiliates andsubsidiaries and their respective officers, directors, employees, agents)harmless from any claim or demand, including reasonable legal fees, made by anythird party due to or arising out of your breach of this User Agreement, yourimproper use of our Services or our Site or your breach of any law or therights of a third party.

SHIPPINGCLAUSE & LIABILITY WAIVER

The Buyer is responsible for all shipping and handling fees. All orderswill be Local Pickup or shipped via freight with the Buyer responsible forscheduling and providing the Seller with proper shipping documentation. Shipping& handling fees of oversize items will be determined during the paymentprocess. The item(s) of this sale may be shipped without insurance if the Buyerexpressly requests this during the shipping process with the Buyers freightcompany. Without other arrangements with the Seller, the Buyer agrees to shipall orders 5 days after time of payment.

The Buyerassumes any and all liability and risks which may arise from any shipments.Further, the Buyer agrees on behalf of itself and its successors and assigns toindemnify, hold harmless and release the Seller its directors, officers,employees and agents, from any responsibility or liability for any and alldamage or loss that may result during the shipping process.
