Earnest man seeks compensation for destruction of his patrimonial collection by his landlords ! - 12/18/20 10:07 PM

David Werking, who was living with his parents following a divorce, sued them over the items, which he claims were worth over $25,000 (£18,500).

His parents argued that they told Mr Werking to not bring the items home.

The judge said that, even as landlords, Mr Werking's parents had no right to dispose of items owned by their son.

The parents said they were not willing to help move the items to Indiana and did not want them in their home.

Mr Werking filed the lawsuit arguing the items were illegally destroyed in April 2019.

Emails between Mr Werking and his father stated that the items included 12 full boxes of "pornography plus two boxes of sex toys", according to the Sentinel. Mr Werking said there were over 1,600 DVDs and tapes.

In one, Mr Werking's father told him he did him a "big favour by getting rid of all this stuff".

Following the verdict, an attorney for the parents said she was working to determine the damages, and had hired an expert from the Erotic Heritage Museum in Nevada to help with the process.

Kind of a young dude to have a collection of physical porn that size, internet already had virtually infinite by the time he was in his early 20's...

Now that's a bee s lawsuit. It's like someone calling 911 demanding the police for something not criminal or to order a pizza or asking for a ride to Taco Bell.

It is a reasonable claim against conversion of property.

The claimed damages are $25,000 with a request for triple damages due to the wilful destruction. Summary judgement has been issued in his favour, and now all that remains is for the court to rule on the value of his losses and the amount in judgement (which could in theory range anywhere from $1 to $75,000

guy is suing his PARENTS who TOOK HIM in when he got dumped and without a place, same parents refused that he brought his collection....he should paid for one of those conteirners to hold value that ou americans seem to have everywhere.....or sell of it if needed the money.
guy is a d1ck........i hope the exwife takes all that money from him.

They have a right to kick him out... which they exercised. They have no right to convert his property when they do so. They broke the law, and the court has sided with him in summary judgement, based on the statement of the case made by both parties.

Parents would have been within their rights to throw the stuff off their property, but destroying or selling it puts them in the wrong.

What would be the reaction here if this had been a $25k GUN collection?

Or a $25k video game collection?

pissed, but i would never sue my #%&*$# parents, specially after they took me in a time of NEED.

Neither would I, but the thought also just occurred to me - how much was he in "need" in the first place if he had a $25k porn collection? I personally am not in the habit of helping someone who's "down on their luck" but has $25k in non essential assets (unlike, say, a car).

For sure, then again there's probably some "fellow enthusiast" out there somewhere who might drop a few grand for it...

I was more about the ability to "invest" that far in the first place - unless the man is spending every last dime on porn he's got other things as well...

If I was housing someone "down on their luck" and started seeing they have tons of stuff they could sell (but they just don't want to) I'd be booting and changing locks.

I'm not defending this guy. But I'm also not defending how the parents handled it. Property is property. Doesn't matter if someone else doesn't approve of said property unless it's illegal property.

Agreed.....especially if half of the material is now unviewable with all those pages stuck together....

After reading about all the details of this guy I'm not surprised at all that he got divorced. I'm 99% sure it was his wife who dumped him and not the other way around.

This is kind of an intriguing story to me because of the moral dilemma factor...

Morally speaking I might kind of be on the fathers side - not because I have anything against porn, but it definitely seems the son had gone to the point of an addiction problem with it. If the father acted solely because he objects to porn itself however, well that puts me right back on the sons side (even if it was in excess to the point of an addiction problem). You don't tell me what LEGAL items I can or can't own, and I certainly would never try that on someone else.

Which takes me to LEGALLY speaking - on that level the father was in the wrong, period. I'll repeat, yes there'd have been every right to throw the stuff off their property (well, littering/dumping considerations aside!), but that's a lot different from destroying the stuff. If I'm being an idiot and blowing all my money on collecting postage stamps then sure, maybe I need some kind of intervention, but it doesn't give anyone the right to go and DESTROY the stuff...

But then it goes back to morally speaking again - I'm 95% sure I can't get behind the son suing the parents over it either...

Yeah I'm bored today, I'm near the end of a 14 day self quarantine before I go visit my 72 year old mother for Christmas...
