Good lord,watched a video about the A380 and the development of it and its wake turbulence. Amazed the aircraft regained control, where most would have lost it or broke up.

Only 1000ft above? That seems to violate minimum separation rules, doesn't it? Seems like a failure on ATC's part.

The incident happened while they were over the ocean, so they were most likely out of radar coverage. They should have SLOP'd (I always do when I'm flying out of radar coverage).

SLOP is required by US carriers (maybe all of ICAO). But I often use a SLOP of "0" if there is a left crosswind. Fortunately the authorities were smart enough to include that as an option. Wake encounters happen even when the guidelines are followed. I caught it climbing through 200' out of Atlanta just a couple of days ago. The recovery briefly required full left aileron. The previous airplane was a lowly MD80 (mine was an even lowlyer 737-700).
