Its not stolen content from PCARS, SMS was contracted to do this, and was never paid.

SMS has been busy! I hope it works out for them. They did the Test Drive Ferrari game that just came out as well as the other projects they've had going on. I wonder if the Ferrari-Porsche rivalry has anything to do with them getting dropped or whatever is really going on here.
Haven't tried the Ferrari game yet, but I intend to.

I think Whe he is saying that SMS was order by PCARS to develop it but was never paid by PCARS. So in that case it is not stealing. On the other hand ownership in the software world is not always defined very well.
