Hi Guys.

It might be an idea to post links to sites where anyone could get a download a full version of EAW.

I've had a look around, but nothing legal, other than the Demo version.

It would be helpful for anyone who want to play EAW, but has no disk, and can use it to update to 1.4.

But that is only one copy trindade, if he still has it. What we need is a perminantly available legal download of the full game.

Maybe, if there is no download available anywhere, it might be time to ask Atari if we could post full versions of 1.4.

After all, we got permission to work on the code many years ago, and EAW is now a staggering 16 years old. Surely, there must be a case to make EAW abandonware, and make it free for us to post our new versions, freely.

So I checked it out and this is what I found:



They claim it runs on a modern PC.
What no 7217 error?
Have they borrowed one of our versions?
Did they get permission from ATARI?


If you click the right areas to get a free version the d/l speed is slow.

However, if a free download is legally available from this crowd, then what is to stop us from offering one too?

I've sent an email to the site owner asking what the situation is. I'm a bit reluctant contacting Atari, as Nate had all the contacts, and I don't know who signed our deal. Until we get some firm info on the situation, I'd hold off posting anything complete. wink

I doubt it is a legal download because the site is also offering Panzer Elite, which is NOT abandonware and NOT legal to download. smile but thanks for pointing the site out, email already sent to the lawyers.

I was surprised by the number of games available, such as WOV and two versions of Microsoft CFS2, and CFS3.
Surely they are not legal.

As Atari is owned by a French company I did some checking

Hi Allen.

I was thinking the same thing. So many of the Google search results for EAW are blocked by my server, which makes you think these sites are offering illegal content.

Atari AU, used to sell EAW as a download a few years back, but I can't even find the Atari worldwide sites anymore.

It seems EAW has slipped into Grey history, not available legally anywhere, other than on an a old CD. frown

Have you ever thought of offering to remaster a disk with the original 1.2 and a way to enable your version of EAW?

I remastered PESE for Nordic Games and included all the updated mods I could get permission of the mod makers. Nordic Games updated the GOG.com download version of PESE and rebundled it with PEA, releasing it as a collection. Heck, I was even offered the code for PEA to merge then into one game.

You never know, you might get exactly what you want.

Interesting idea, but it would cost a shed load of money, and we have nothing finished which could be packaged into a saleable product. Also our community has dwindled, which means finishing off everything needed to make a finished game.

The only way to go is to make a full download available.

I've been reading about Abandonware, and it turns out nothing is leagaly Abandonware.

It does not cost a shed load of money. I am not saying to reprint the disks, I am saying to remake a master copy. You would include EAW 1.2, which is done, stable and complete. If Atari still has an unmolested copy of the code, you could fix the 8 bit, 7212 error if you wanted, but that is not necessary since DOS Box and Win8 allow it to run. Then you need to finalize (drop the features that are not ready) one or two versions of your code work. Then Atari could offer it as an inexpensive download.

PESE sells on GOG for $5 and on sale for as little as $1. I did not charge Nordic Games anything, and I was allowed to keep my source code changes. Though I was required to sign a 5 year NDA, but that was mainly for access to the PEA source. In the end, the only cost to Nordic and GOG is server space. It's unfortunate that people would rather pirate a copy then spend $1.

It couldn't hurt to ask Tony and the rest if they have any objections to signing a release allowing Atari to publish there work. If there were no objections (I have no objection, even if Atari wants the source), then you could have a discussion with Atari.

I am not overly concerned with the concept of Atari releasing a version for example 1.40 which has my intellectual property in the code.
What would be a big bother is their release of theatres such as SPAW for a fee, as these contain work from several modders.

In line with this am thinking of making a basic 1.40 release with a "Default_planes" folder containing only the default skins and FMs and an "ETO_basic" folder with a single planeset.
I would include the "DirSetExeManager" program as the file manager.

That would set things up so that other scenarios can be downloaded free from us or Sandbagger's.

I've not had a reply from Atari yet. I suppose they are having to find out what the game was! Anyway, that's a good idea. Just make a Vanilla verion of 1.4 incorperating as much as possible of the default Microprose 1.2 game.

Have all the default screen graphics been reworked to 1024x768?

I would expect a week or so while Atari checks out who you and the other modders/code group are and if your work could generate new sales. It would help them to decide if you included a summary of who you are, what you have done with the game and where they should look to view your work.

It depends how you view the fee. The reality of the fee is that purchaser if paying for EAW 1.2. The modders work is already available for free, and that does not need to change. It's included in any new version as a free bonus. Having as much as possible working together in one download would be a benefit to new players. It could also be considered a baseline install for people looking to re-install EAW and wondering what mods they want to start with.

I don't pretend to know what Atari would require, but Nordic needed an email giving permission or proof that the author has the work offered freely for any use. The words "you can use it as you wish" are a release of copyright. I had to sign an NDA because I had access to the company's server.

I'm in the middle of rewriting the terrain following routines of PE's wheels and I have a full tune-up with valve adjustment on a Polaris 500 Scrambler for the day on Wednesday. I need to re-install EAW onto my backup XP machine, which has my sticks and rudder. I will have feed back for you by the end of the week. I guess it will be a good opportunity to write up an install from nothing to what you are purposing.

...and then I had another idea.

I have not used it much, but Ralf set-up the "Savedata" folder as the default folder for files.
I extracted all the "snd" and "wsd" files from the eight CDFs that contained them, and put them in the "Savedata" folder.
Then I compiled a 140 exe which no longer referenced these CDFs, and shifted them into a folder called "HIDE".

The exe works. I heard the speech in flight, the explosions, and the briefing text in career missions.



The "HIDE" folder is not needed, the "Savedata" folder is 82.5MB and when 7-zipped it is 58 MB so there is some space saving in terms of downloads.

... and then I realised that the files in "cockpits.cdf" as the files in are not used by the 1.40 exe, so I made another which does not reference it.
I have packed the entire 212 MB folder in a 117 MB 7-zip file. It is on its way to OneDrive
If you run it you get a working 1.40 folder, apart from putting in your "eaw.ini" if you have one.

An extension of this would be to have a very large "Savedata" folder containing the default files and no CDF files wink
It would make an even smaller download as the files in the CDFs are not compressed, so they take up more space than they need.

When the code was released to the community, wasn't it stated that we could do whatever
we wanted with it as long as it was NOT for profit?

Ive been installing all day runs great as a base install...But most of the sets on 1.40 wont work.Think the ETO\DAW was the only one that did...Does anybody else have any luck with any of them???I tried moving the dir sets now installed to the not installed folder and tried to set up SPAW and it wont run and starting some others gives me an error 53.Still going to try and set a few up.

At the time of the agreement, EAW was still available as a pay download, from Atari, and several other pay sites, so we were never allowed to offer full downloads.

Also, we were never allowed to charge for any of our mods, including exe realeases.

Now we have no way for anyone to get a legal copy of the default game, so unless you have a working disk, or can pick one up, there is no way for new players to try the game.

Yes, it's 16 years since EAW was released, and there is a whole new generation who have never had the chance to play it, on many platforms.

So we need to get permission from Atari to post a free full version, or Atati to post out updated EAW, on their website, so it can be legally downloaded once again.

I didn't know there was anything in the agreement that stated we could not offer free, full, modded downloads.

I don't have a copy of the agreement and I asked Moogy to remove me from the Gen, do to my NDA. I still think it is best I stay out of the code work untill I have no NDA.

I define "full" as every file needed to fly against the AI or another human.

"Full" is the word I worry about. I have never seen an agreement that allows the full release of intellectual propery rights. My personal opinion is that "full" release of EAW diminishes or dilutes the trademark and intellectual property rights of the copyright owner of EAW. I have always been told that Atari is the owner of EAW as intellectual property.

I agree with AO, that it should be asked if Atari has an objection.

Customer support is not who you need to talk to. Customer support is for the end user. You need to talk to someone in product development or legal (what ever wording Atari uses from those departments).

I have no other contact to use. I'm using them as a starting point, and I hope I will be passed up the food chain, to someone who will have the agreement, and will be able to talk with the CEO about our case.

It would be much easier for Nate to have done this, has he had the direct email contacts, but I have nothing, so I'm working from the bottom up. smile

Before you try to run EAW you must use the DirSetExeManager with these selections and make sure you pick a planeset even though only one is available.

So am I right in assuming the 1-40 no Cd does not need the various files from the original game that you told us to load for the previous versions and remind me please , where the heck can I find my EAW.ini file - sorry getting old (though younger than you) and my memory is going.
