In this instance it was not the state of California's fault. The blame for his living this long falls on the US Supreme courts shoulders. Had they not found the death penalty, as it was being practiced in several states, unconstitutional and suspended all death penalty sentences in all the states he and his followers would have been long dead. Once their sentences had been downgraded to the next highest available at the time there was no legal way for the state to reinstitute their original sentences. Ronald Reagan was the governor during that time frame and he would have been more than happy to carry out the original sentences of the Manson family if the Supreme Court had not intervened on all death penalty cases nation wide.

Thanks for clearing that up wheels. I believe the same thing happend to David Berkowitz (Son of Sam). He committed his crimes during the Federal moratorium on the death penalty so he got life instead.
