What if you just point the camera at the wall, etc?

Question everything!

Regardless of wether the patent is used...wouldn't you see a Kinect camera that is mandatory matched up with an "Always on-Always connected" device a bit of an issue? And yes, "Always on-Always connected" were the words used in SDK given to developers in the paragraph above the mandatory Kinect paragraph.

I just want to point out to everyone,

The Kinect 2.0 Camera is built into the console.

So it can never be disconnected.

Moral of the Story here:

Dont listen to the Specs/SDK/DevKit Guide Lines 8 months before the console comes out.

If your referring to the link I posted...I didn't see anywhere that indicated it was a "separate" device. It just said every console will be "sold with" not specific and is still technically true

Quote:
Microsoft has patented a system where it watches you to see if multiple people are viewing a film (so it can charge more) or if you are old enough to play something. It’s like having the police sitting on top of your TV.

Microsoft isn’t known for being the best friend of privacy protection, and this seems like a step too far. If this is true, and we aren’t given a good reason for it, I’ll be incredibly hesitant to buy an Xbox 720, even though I wouldn’t keep it in my murder room.

Quote:
Having a company spy on you and your friends and shutdown your content due to copyright licensing (or the lack thereof) is an obvious cash grab. Can you imagine the Xbox 360 pausing a movie right in the middle of playing and saying “Warning: maximum amount of allowed viewers exceeded. Please purchase more licenses to continue accessing your content. Thank you.” And then it takes you to a screen where you have to lay down some extra cash just to keep watching the movie or TV show? The amount of crap contained within that kind of corporate dictatorship cannot be put into words.

This is a by-product of those gamers growing acceptance to intrusive DRM, and spyware/data mining schemes. I can hear them already like when Origin was released "If you have nothing to hide, it shouldn't be a problem! Besides, I have to have my digital crack"

<sigh>

A. When you pay for a License for Private Screening/Viewing of Video Content,
Per the MPAA there is no "AUDIENCE" Limit. as Long as it's shown in the Privacy of your own home.

So MS Cannot Charge more by "Detected Bodies"

B. As for seeing if you're "Old Enough", That isnt going to happen either, Per ESRB, if a Parent or Consenting Adult buys a M Rated Game and Consents their child to play it, the Parent is Responsible for Overseeing the Child during Sessions.

C. As for Randomly Spying on you, Nothing a Piece of DuctTape and a Picture of Jessica Alba wouldnt fix.

Again though, the Purpose of Kinect 2.0 has nothing to do with 90% of the "Features" these "SDKs" that are Published are listing.

Kinect 2.0 is, a Better version of Kinect, more precise tracking for single and multiple users, etc.

It will NOT Be used in the manner these recent articles are putting out, they simply talking borderline BS.

MS, Sony, Nintendo all develop Hardware and Software technologies on a Daily Basis, and 99% of them are simply Patented and locked up.

using the Kinect Camera in the Unit in the manner these articles are publishing is a Violation of a least 20 FCC Laws. and there is no way to "Consent" to MS Doing it (not that anyone would.)

It doesn’t matter how much evidence you throw at Hollywood or their associated copyright enforcement agencies, piracy and the viewing of illegally acquired content will always be something they want to wipe out. A new patent application from Microsoft could well aid them in that quest.

The patent has the ominous title of “Content Distribution Regulation by Viewing User.” It details a system whereby the people sitting in view of a TV can be detected using cameras and sensors like those found in the Kinect motion controller. Once logged, the content provider can assess the audience and either choose to charge more for viewing the content or block access based on there being too many people.

No where does it CONFIRM or Directly Say that the Next Console/Kinect will do anything,

MS **COULD** use Sensors **LIKE** the Kinect.

Further More, MS is not the Content Provider (that would be the Movie Studio/Publisher), and they arent gonna sit on XBL to Limit users from watching their movies.

Like i said, they are "hypothesizing" stuff that they have no clue about.

Look at the 9000 articles that writer has published, a bunch of nonsense and alot of COPY/PASTING.

and there is no "DURANGO OVERVIEW" in the Visual Studio 2012 Public SDK Documents.

I understand it doesn't mean it will be used, but they are looking into it for sure.

And then there is the TOS you agreed to for the original Kinect:

Quote:
If you accept the agreement, you “expressly authorize and consent to us accessing or disclosing information about you, including the content of your communications, in order to: (a) comply with the law or respond to lawful requests or legal process; (b) protect the rights or property of Microsoft, our partners, or our customers, including the enforcement of our agreements or policies governing your use of the Service; or (c) act on a good faith belief that such access or disclosure is necessary to protect the personal safety of Microsoft employees, customers, or the public.”

Did you catch that? Here, let me print the important part in really big letters.
“If you accept the agreement, you expressly authorize and consent to us accessing or disclosing information about you, including the content of your communications… on a good faith belief that such access or disclosure is necessary to protect the personal safety of Microsoft employees, customers, or the public.”

OK, is that clear enough for ya? When you use the Kinect system, you agree to allow Microsoft (and any branch of law enforcement or government they care to share information with) to use your Kinect system to spy on you. Maybe run that facial recognition software to check you out, listen to your conversations, and keep track of who you are communicating with.

Not sure how accurate that statement is exactly.

that statement is completely false.

They cannot INITIATE a connection to your Device at all,

They CAN however: Monitor Images Sent, Videos Sent, Audio Sent, Text Messages Sent, as well as Video Chat sessions.
And Forward those items to law enforcement agencies if the content is needed.
Which they already do in MSN Messenger and now Skype.

Let me say it again,
MS CANNOT RANDOMLY OPEN A CONNECTION TO YOUR KINECT UNIT AND WATCH IT LIKE A TV CHANNEL..

They CAN MONITOR ACTIVE VIDEO CHAT SESSIONS, SCAN TEXT, VIDEO AND AUDIO MESSAGES, and If Needed FORWARD THOSE TO LAW ENFORCEMENT AGENCIES.

The same thing being done to Skype, MSN Msgr, Cell Phones etc.

It's not spying, and it;s nothing more than every other Communications Infrastructure (Phones, Email, etc) dont already do.

If you dont do anything to flag your account, they'll never have a need to even look at your content.

When Kinect first launched, some idiot was sending people sending videos of himself doing naked cartwheels in front of the camera.

Vienna, 2nd rock left.
Skatezilla, I have to half disagree on that. Yes, M$ can't open a connection from outside (on any half decent home firewall) but they could have the Kinect establish a channel from inside out. Unless you keep track of your outgoing network connections (and not many people on a private ISP/Wifi do) you won't see that.

If they did this, they know the new xbox will be a bigger turd than the zune. No one will buy it. Plain and simple.

MS isn't stupid and they have shareholders to answer to.

I still feel comfortable saying this rumor is crap.

See : Zune, Zune HD

I still have my Zune HD, but they abandoned it.

it was supposed to link with the Xbox 360 the same way they have smartglass working now.

But nawt.. I had to hack and backup my ZuneHD Apps cuz they removed them from the Zune Software.

I can Verify, MS Cannot randomly open a connection to your XBOX, nor Control the accessories hooked to it.

But they could/can/have already programed APPs to Take a Picture and send it to them smile.

Now 'THAT' bothers me.
I don't have any 'apps' or even a smart phone.
But the 'idea' is revolting.
And I'm sure, in some venues, illegal, when done without the owners permission.
Even without the subjects permission, the one in the photo.

Yeah, I find that very disturbing.
I do hope you are wrong Skate....but knowing your history a little, I doubt that.

Yep, that's going too far...stepping over the edge.
If that's true, it'll come out, and it won't be good for them.
Not good at all.......

You got stock.....I'd sell it.

Hopefully there will be some actual *facts* soon, but I'm sure the sites that post FUD and rumors don't mind the hits from you guys in the meantime...

Those of you who don't like to support companies who use DRM might want to have a similar policy for not supporting web sites who publish FUD (Fear Uncertainty and Doubt) for the advertiser hits.
