It's ok I have an agreement that states that by letting me use their service they are allowing me to sue them for everything they have. It is dated and signed by my lawyer pre-new EULA. It is worth about as much as their agreement is worth. (IE Nothing)

Which other company did that a little while ago? EA? Just for their Origin "service", or all new games?

If one agreed to that one, they should be consistent and take that lying down too. stirthepot

I saw the new XBL EULA and agreed to it, it's not as if we really had good rights when it comes to XBL anyhow, there's no refund and for months Microsoft has been taking hacked accounts and putting them into 45 day waiting period where you can't use your gametag account or XBL unless you agree to create a new one... so instead of correcting the problem they just want to disable the account and have you start a new XBL profile, I found this out when my XBL account was hacked via FIFA12 a few weeks ago, Microsoft refuses to acknowledge the hack and provides little in the way of options, thankfully with the help of a good customer support person I was able to reset the password and take over my account to get it back from the hacker and not have to stay offline for 45days to keep my gamertag...

So for me our XBL rights and their official customer support of XBL was already a bit bogus anyways... now they just codified it with a EULA that you have to agree to or forfeit XBL.

I'm not part of OWS but I think they have a good point about the corporations owning and manipulating pretty much all that we watch/play/buy strictly for their benefit and not any common good, only those that have money for lawyers, or influence politicians or drop off the grid and don't consume are not affected.

So to summarize, yes the current EULA sucks, but you didn't really have much rights in the old one either, you just didn't know it ahead of time, the only alternative is to eventually stop using XBL, PSN, Origin, Steam, installing any new games etc.

So count me in the group that is already taking this crap lying down, I'm too busy with life/work/family to go camp at OWS and I enjoy the little time I spend playing these games, I already assumed these corporations were out for themselves so no surprise seeing it in the EULA hehe.

I'd love to see this enforced, since XBL Gold is a pay service, and many people (including myself) purchased memberships years in advance of the EULA (my membership goes until 2014).

the whole XBL/FIFA hasnt even been resolved yet, and has moved outside of FIFA, its supposedly being reported on the D.L. that hackers are calling support pretending to be you, and getting your passwords that way.

Wow that is sad to hear, the biggest surprise for me as a XBL customer was the lack of security process for MS who is otherwise such a security conscious company... I told them my account was hacked, using FIFA12 demo which I don't own and had only installed the demo, and they said, hmm that's interesting, we can either lock down your account for 45 days, or you can create a new gametag or we can reset your password and try to take the account back from the hacker...

Pretty unimpressive options I'm just thankful the support person I worked with was willing to do #3 a few times as while we were on the phone resetting the password the hacker kept getting back in via my security question, I've read of other people who had less helpful support and had to do the 45 day lockout or lose their gametag.

So the summary still stands, these EULAs suck but I don't think the rights you had under the old EULA were anything to brag about... which is why MS can offer you the option of losing all your account data or wait 45days while they investigate, even with the old EULA.

my sources say the 45 day lockout/investigation lasts more like 70-80 days.

MS is claiming nothing is breached. But every user has Linked their EA account to their XBL Account.
FIFA was the title being downloaded and items bought for at first, now its "the sims 2" and other big EA Games.

Yeah exactly, while MS and EA figure out who has the problem, MS lets their customer suffer, the customers who just saw the FIFA12 demo advertised on their XBL dashboard and installed it from XBL and just followed the directions requiring linking to EA...

If MS doesn't think the hack is via XBL and instead via EA, then least they could do is quit presenting their XBL customers with the hacked EA products and quit allowing those products to be linked to their XBL accounts.

Right now they do nothing to acknowledge the problem other than offer to lock the account for weeks to investigate... thankfully the MS XBL support guy who helped me was awesome and restored the XBL points the hacker stole and worked with me until we were able to lock the hacker out and let me take my account back, but I have a feeling this was an exception and most other XBL customers get stuck with the weeks of no XBL even though they paid for it, or they have to start their XBL account from scratch with a new tag which is piss poor support from MS IMHO, at least Sony eventually admitted their PSN security problems and provided some customer compensations :-)

Microsoft's XBL hacking keystone cop impersonation continues, maybe now with the EULA protection they don't give a damn:

Good to know my experience wasn't unusual, but hard to believe that they still haven't found a better way to handle it and don't care that the XBL brand is losing it's gold tint, the only way to be safe is to make sure you don't have a valid credit card or paypal linked to your XBL account, maybe someday MS will put in some sort of check when someone uses your XBL account to move it to russia or to purchase family accounts or hundreds of dollars of points...

Ironically enough I was one of those affected by the PSN security breach but never actually had anything stolen, unlike my XBL account from this hack.
